General terms and conditions

1. scope of application

For all orders via our online store, the following terms and conditions apply. Our online store is aimed exclusively at consumers. Consumer is any natural person who enters into a legal transaction for purposes that can be attributed predominantly neither to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

2. contracting party, conclusion of contract, correction possibilities

The purchase contract is concluded with Amuura pvt Ltd.

By placing the products in the online store, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction tools provided and explained for this purpose in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.

4. delivery conditions

In addition to the stated product prices, shipping costs may still be incurred. You can find out more about any shipping costs in the offers.

We deliver only in the dispatch way. A pickup of the goods is unfortunately not possible.

In our store, the following payment methods are generally available:

Credit card: In the ordering process you enter your credit card details.

Your card will be charged immediately after submitting the order. 

PayPal: To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. 

The payment transaction is carried out by PayPal immediately after placing the order. You will receive further instructions in the order process. 

Google Pay: In order to pay the invoice amount via the payment service provider Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. You will receive further instructions during the order process. 

Apple Pay: In order to pay the invoice amount via the payment service provider Apple Inc, One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions in the order process. 

Klarna: In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options. Payment via Klarna is only available to consumers. Unless otherwise provided below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will receive further instructions with the respective payment option and in the order process. 

Purchase on account via Klarna The invoice amount is due 14 days after shipment of the goods and receipt of the invoice. 

6. reservation of proprietary rights

The goods remain our property until full payment.

7. transport damages

If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the deliverer and please contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

8 Warranty and guarantees

9 Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation in the event of injury to life, limb or health, in the event of intentional or grossly negligent breach of duty, in the event of warranty promises, insofar as agreed, or insofar as the scope of application of the Product Liability Act is opened.  In the event of a breach of material contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and compliance with which the contractual partner may regularly rely on (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.  Otherwise, claims for damages are excluded.

For the purpose of contract processing (including inquiries about and processing of any warranty and performance claims that may exist, as well as any statutory update obligations) in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO, we collect personal data if you provide it to us voluntarily as part of your order. Mandatory fields are marked as such, because in these cases we need the data to process the contract and we cannot send the order without their information. Which data is collected can be seen from the respective input forms.  Further information on the processing of your data, in particular on the transfer to our service providers for the purpose of order, payment and shipping processing, can be found in the following sections of this privacy policy. After complete processing of the contract, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law in accordance with Art. 6 para. 1 p. 1 lit. c DSGVO, unless you have expressly consented to further use of your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration. 

2.2 Customer account

Insofar as you have given your consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO by deciding to open a customer account, we will use your data for the purpose of opening a customer account as well as for storing your data for further future orders on our website. Deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described in this privacy policy or by using a function provided for this purpose in the customer account. After deletion of your customer account, your data will be deleted, unless you have expressly consented to further use of your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement.

In the context of customer communication, we collect personal data to process your inquiries in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO if you voluntarily provide us with this data when contacting us (e.g. via contact form or e-mail). 4.3 Identity and credit check when selecting Klarna payment services

Purchase on account via Klarna: If you choose to use the payment services of Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (hereinafter Klarna), we will forward your data to Klarna as part of the payment and contract processing pursuant to Article 6 (1) sentence 1 lit. b) DSGVO. The transmission of this data takes place so that Klarna can create an invoice for the invoice processing requested by you and carry out an identity and credit check. Please understand that we can only offer you the respective Klarna payment method if this is made possible based on the results of the credit check. 5.1 General information

On our website, we use Cookiebot to inform you about the cookies and the other technologies we use on our website, as well as to obtain, manage and document your consent, if required, to the processing of your personal data by these technologies. Pursuant to Art. 6 (1) p. 1 lit. c DSGVO, this is necessary to fulfill our legal obligation under Art. 7 (1) DSGVO to be able to prove your consent to the processing of your personal data, to which we are subject. Cookiebot is a service provided by Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark, which processes your data on our behalf.After you submit your cookie declaration on our website, Cookiebot's web server stores your anonymized IP address, the date and time of your declaration, browser information, the URL from which the declaration was sent, information about your consent behavior, and an anonymous random key. In addition, a cookie is used that contains the information about your consent behavior and the key. After the end of the purpose and the end of the use of the respective technology by us, the data collected in this context will be deleted. Use of Google services for web analysis and advertising purposes 

We use the technologies of Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), which are described below. The information automatically collected by Google technologies about your use of our website is usually transmitted to a server of Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA and stored there. For the USA, there is no adequacy decision of the European Commission. Our cooperation with them is based on standard data protection clauses of the European Commission.  If your IP address is collected via Google technologies, it is shortened by activating IP anonymization before being stored on Google's servers. Only in exceptional cases will the full IP address be transmitted to a Google server and shortened there. Unless otherwise specified for the individual technologies, the data processing is based on an agreement concluded for the respective technology between jointly responsible parties in accordance with Art. 26 DSGVO. Google Analytics

For the purpose of website analysis, Google Analytics automatically collects and stores data (IP address, time of visit, device and browser information, and information about your use of our website), from which usage profiles are created using pseudonyms. Cookies may be used for this purpose. As a matter of principle, your IP address will not be merged with other data from Google. Data processing is carried out on the basis of an order processing agreement by Google.

For the purpose of optimized marketing of our website, we have activated the data release settings for "Google products and services". This allows Google to access the data collected and processed by Google Analytics and subsequently use it to improve Google services. Data sharing with Google under these data sharing settings is based on an additional agreement between responsible parties. We have no influence on the subsequent data processing by Google. 

For the creation and execution of tests, we also use the Google Analytics Google Optimize extension function. 

For the purpose of optimized marketing of our website, we use the so-called User ID function. With the help of this function, we can assign a unique, permanent ID to your interaction data of one or more sessions on our online sites and thus analyze your user behavior across devices and sessions.

For web analysis, the Google Analytics Google Signals extension function enables so-called "cross-device tracking". Insofar as your internet-enabled devices are linked to your Google account and you have activated the "personalized advertising" setting in your Google account, Google can generate reports on your usage behavior (esp. cross-device user numbers), even if you change your terminal device. A processing of personal data by us does not take place in this respect, we only receive statistics generated on the basis of Google Signals. 

YouTube video plugin 

To integrate third-party content, data (IP address, time of visit, device and browser information) is collected via the YouTube video plugin in the extended data protection mode used by us, transmitted to Google and subsequently processed by Google only when you play a video. 

7. social media

7.1 Social plugins from Facebook (by Meta), Instagram (by Meta).

Social buttons from social networks are used on our website. These are only integrated into the page as HTML links, so that when you call up our website, no connection is yet established with the servers of the respective provider. If you click on one of the buttons, the website of the respective social network opens in a new window of your browser There you can, for example, press the Like or Share button.

7.2 Our online presence on Facebook (by Meta), Instagram (by Meta), Youtube.

Right to object Insofar as we process personal data as explained above in order to protect our legitimate interests, which prevail in the context of a balancing of interests, you can object to this processing with effect for the future. If the processing is carried out for direct marketing purposes, you can exercise this right at any time as described above. If the processing is carried out for other purposes, you will only have the right to object if there are grounds arising from your particular situation. After exercising your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims. This does not apply if the processing is for direct marketing purposes. Then we will not further process your personal data for this purpose.
